1. เกี่ยวกับ Night Birdie
Night Birdie เป็นแอปที่ช่วยให้นักกอล์ฟหาและจองแคดดี้ที่สนามกอล์ฟในประเทศไทย ดำเนินการโดย Tan Tao กรุงเทพมหานคร ("เรา") การสมัครหรือใช้แอปถือว่าคุณยอมรับข้อกำหนดนี้และนโยบายความเป็นส่วนตัว หากไม่ยอมรับ โปรดอย่าใช้แอป
Night Birdie เป็นบริการจองแคดดี้สำหรับการเล่นกอล์ฟเท่านั้น ไม่ใช่บริการหาคู่ เพื่อนเที่ยว หรือบริการทางเพศ แคดดี้ไม่ใช่พนักงานของเรา
2. ใครใช้ได้
- นักกอล์ฟต้องมีอายุ 18 ปีขึ้นไป แคดดี้ต้องมีอายุ 18 ปีขึ้นไป
- หนึ่งคนหนึ่งบัญชี ใช้ข้อมูลจริงของตัวเอง และดูแลรหัสผ่านให้ปลอดภัย คุณรับผิดชอบสิ่งที่เกิดขึ้นในบัญชีของคุณ
- บัญชีแคดดี้ที่สมัครใหม่ต้องรอทีมงานอนุมัติก่อนนักกอล์ฟจะเห็นและจองได้
3. การจองและการออกรอบ
- นักกอล์ฟส่งคำขอจอง แคดดี้ตอบรับหรือปฏิเสธ คำขอที่ไม่ได้ตอบภายในเวลาที่กำหนดจะหมดอายุเอง
- การยกเลิกช้า การไม่มาตามนัด และการแจ้งว่าอีกฝ่ายไม่มาโดยไม่จริง อาจทำให้คะแนนเครดิตลดลง และอาจถูกจำกัดการใช้งาน
- แคดดี้เช็กอินด้วยตำแหน่ง GPS ตอนเริ่ม ระหว่าง และจบรอบ เพื่อยืนยันว่ารอบเกิดขึ้นจริง รอบที่ตรวจสอบไม่ผ่านอาจถูกระงับหรือปฏิเสธโดยทีมงาน
- ขณะนี้นักกอล์ฟใช้ Night Birdie ได้ฟรี ค่าบริการของสนาม ค่ากรีนฟี และค่าแคดดี้ตามระเบียบสนามเป็นเรื่องระหว่างคุณกับสนาม
4. ไม่ยอมรับเนื้อหาไม่เหมาะสมและผู้ใช้ที่ก่อกวนโดยเด็ดขาด
เราไม่ยอมรับเนื้อหาไม่เหมาะสมหรือการใช้งานในทางที่ผิดในทุกกรณี ห้ามโพสต์ ส่ง หรือทำสิ่งต่อไปนี้ในโปรไฟล์ แชท โพสต์ สตอรี่ ความคิดเห็น หรือรีวิว:
- ภาพโป๊ เปลือย หรือเนื้อหาทางเพศ หรือการขอ/เสนอบริการทางเพศ
- การคุกคาม ข่มขู่ กลั่นแกล้ง ติดตามรังควาน หรือพูดจาหยาบคายใส่ผู้อื่น
- ถ้อยคำแสดงความเกลียดชังหรือการเลือกปฏิบัติ ความรุนแรง หรือการทำร้ายตัวเอง
- สิ่งผิดกฎหมาย การหลอกลวง สแปม โฆษณาที่ไม่ได้รับอนุญาต หรือการแอบอ้างเป็นผู้อื่น
- การเปิดเผยข้อมูลส่วนตัวของผู้อื่นโดยไม่ได้รับอนุญาต
ฝ่าฝืนแล้วเนื้อหาจะถูกลบ และบัญชีอาจถูกระงับหรือปิดถาวรทันทีโดยไม่ต้องแจ้งล่วงหน้า กรณีร้ายแรงเราอาจแจ้งเจ้าหน้าที่
5. การแจ้งเรื่องและการบล็อก
- แจ้งโพสต์ สตอรี่ ความคิดเห็น โปรไฟล์ หรือแชทได้จากเมนู "…" ในแอป และบล็อกผู้ใช้ได้ทุกเมื่อ เมื่อบล็อกแล้ว คุณจะไม่เห็นกันในแอป ส่งข้อความหรือจองกันไม่ได้ และการจองที่ค้างอยู่ระหว่างกันจะถูกยกเลิกโดยไม่หักคะแนนเครดิต
- ทีมงาน Night Birdie ตรวจสอบเรื่องที่ถูกแจ้งภายใน 24 ชั่วโมง เนื้อหาที่ถูกแจ้งจากหลายคนอาจถูกซ่อนทันทีระหว่างรอตรวจสอบ
- ทีมงานอาจลบเนื้อหาใดก็ได้ที่ฝ่าฝืนข้อกำหนดนี้ และอาจระงับหรือปิดบัญชีของผู้ที่โพสต์
- เหตุฉุกเฉินหรืออันตรายต่อชีวิต โปรดติดต่อตำรวจ (191) หรือหน่วยฉุกเฉินโดยตรง
6. เนื้อหาของคุณ
เนื้อหาที่คุณโพสต์ยังเป็นของคุณ แต่คุณอนุญาตให้เราเก็บ แสดง และปรับขนาดเนื้อหานั้นในแอปเพื่อให้บริการ คุณรับรองว่ามีสิทธิในเนื้อหานั้น และบุคคลในรูปหรือวิดีโอยินยอมแล้ว สตอรี่หายไปหลัง 24 ชั่วโมง
7. การจัดอันดับ รางวัล และการจับรางวัล
การจัดอันดับแคดดี้และการจับรางวัลของนักกอล์ฟเป็นไปตามกติกาที่แสดงในแอป ไม่ต้องซื้อสิ่งใดเพื่อร่วมลุ้น Apple ไม่ใช่ผู้สนับสนุนและไม่มีส่วนเกี่ยวข้องใด ๆ รอบที่ตรวจสอบไม่ผ่านและบัญชีทดลองไม่มีสิทธิ์รับรางวัล
8. การระงับและการลบบัญชี
เราอาจระงับหรือปิดบัญชีที่ฝ่าฝืนข้อกำหนดนี้ ใช้งานในทางที่ผิด หรือเป็นอันตรายต่อผู้อื่น คุณลบบัญชีได้เองทุกเมื่อที่ โปรไฟล์ → ลบบัญชี
9. ข้อจำกัดความรับผิด
เราให้บริการแอปตามสภาพที่เป็นอยู่ เราพยายามให้แอปทำงานได้ดี แต่ไม่รับประกันว่าจะไม่มีข้อผิดพลาดหรือหยุดชะงัก เราไม่รับผิดชอบต่อการกระทำของผู้ใช้คนอื่น หรือสิ่งที่เกิดขึ้นที่สนาม เท่าที่กฎหมายไทยอนุญาต สิทธิของผู้บริโภคตามกฎหมายยังคงมีผลเสมอ
10. การเปลี่ยนแปลงข้อกำหนด
หากเราเปลี่ยนข้อกำหนดในเรื่องสำคัญ เราจะแจ้งในแอปก่อนมีผล การใช้งานต่อหลังจากนั้นถือว่ายอมรับข้อกำหนดใหม่
11. กฎหมายที่ใช้บังคับ
ข้อกำหนดนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทให้อยู่ในอำนาจของศาลไทย

1. About Night Birdie
Night Birdie is an app that helps golfers find and book caddies at golf courses in Thailand. It is operated by Tan Tao, Bangkok ("we", "us"). By signing up or using the app you accept these terms and our Privacy Policy. If you do not accept them, please do not use the app.
Night Birdie is a caddie booking service for golf only. It is not a dating, companionship or sexual service. Caddies are not our employees.
2. Who can use it
- Golfers must be 18 or older; caddies must be 18 or older.
- One account per person, with your own true details. Keep your password safe; you are responsible for what happens in your account.
- New caddie accounts are reviewed and approved by the team before golfers can see or book them.
3. Bookings and rounds
- A golfer sends a booking request; the caddie accepts or declines it. A request that is not answered in time expires on its own.
- Late cancellations, not turning up, and false no-show reports can lower your credit score and may limit your use of the app.
- Caddies check in with GPS at the start, middle and end of a round to confirm it really happened. Rounds that don't pass the check may be held or rejected by the team.
- Night Birdie is currently free for golfers. Course fees, green fees and caddie fees under the course's own rules are between you and the course.
4. Zero tolerance for objectionable content and abusive users
We have zero tolerance for objectionable content and abusive behaviour. Do not post, send or do any of the following in profiles, chats, posts, stories, comments or reviews:
- nudity, pornographic or sexual content, or asking for or offering sexual services;
- harassment, threats, bullying, stalking or abusive language towards anyone;
- hate speech or discrimination, violence, or self-harm;
- anything illegal, scams, spam, unauthorised advertising, or pretending to be someone else;
- sharing other people's personal information without permission.
Breaking these rules gets the content removed, and the account may be suspended or closed at once without notice. In serious cases we may contact the authorities.
5. Reporting and blocking
- You can report any post, story, comment, profile or chat from its "…" menu, and block a person at any time. Once blocked, you no longer see each other in the app, can't message or book each other, and any open booking between you is cancelled with no credit taken.
- The Night Birdie team reviews reported content within 24 hours. Content reported by several people may be hidden straight away while it waits for review.
- The team may remove any content that breaks these terms and may suspend or close the account that posted it.
- In an emergency or if someone is in danger, contact the police (191) or emergency services directly.
6. Your content
What you post stays yours, but you allow us to store, show and resize it in the app to run the service. You confirm you have the right to post it and that anyone shown in a photo or video agreed. Stories disappear after 24 hours.
7. Rankings, prizes and the lucky draw
The caddie ranking and the golfers' lucky draw follow the official rules shown in the app. No purchase is necessary to take part. Apple is not a sponsor and is not involved in any way. Rounds that fail the check and demo accounts can't win.
8. Suspension and account deletion
We may suspend or close accounts that break these terms, misuse the app or put others at risk. You can delete your own account at any time in Profile → Delete account.
9. Liability
The app is provided as it is. We work to keep it running well but cannot promise it will be free of errors or interruptions. We are not responsible for other users' actions or for what happens at the course, to the extent Thai law allows. Your statutory consumer rights always apply.
10. Changes to these terms
If we change these terms in an important way, we will tell you in the app before the change takes effect. Using the app after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of the Kingdom of Thailand, and the Thai courts have jurisdiction over any dispute.
